Can I File For Bankruptcy More Than Once?

One of the issues that can keep a person from filing for bankruptcy protection is the fear that things may be worse in the future and that if he or she files now, he or she may not be able to file again in the future. While there are some restrictions regarding how often a person can file for bankruptcy protection, it is important to keep in mind that once a person has filed for bankruptcy protection, he or she is often set on a path toward a stronger financial future. Those people may not need the protection of the Bankruptcy Code again.

Multiple Bankruptcies

Even when people have built a stronger financial future, difficult financial situations can arise again. The Bankruptcy Code recognizes the fact that people may need its protection again.

  • Chapter 7 bankruptcy — A person may file for Chapter 7 again after eight years. A person may also file for Chapter 13 four years after being discharged from a Chapter 7 bankruptcy.
  • Chapter 13 bankruptcy — Chapter 13 bankruptcy protection may be filed every two years. A person can pursue Chapter 7 protection six years after being discharged from a Chapter 13 bankruptcy.
