Kevin B. Burgess

Kevin B. Burgess earned his undergraduate degree from the University of Virginia in 1974 and his law degree from West Virginia University in 1977. He is admitted to practice in Federal and State Courts in West Virginia; the Fourth Circuit Court of Appeals; and the United States Supreme Court. Mr Burgess is a member of the West Virginia State Bar, the American Bar Association, the Association of Trial Lawyers of America and the National Association of Criminal Defense Lawyers. He currently serves on the Board of Governors of the West Virginia State Bar. Mr. Burgess has considerable experience in a number of areas of law, but currently his practice focuses on litigation, automobile accidents, and criminal defense.

Light v. Allstate Insurance Co., 506 S.E.2d 64, 203 W.Va. 27, a case of first impression in West Virginia, in which the court permitted the joint trial of first party insurance and bad faith claims

Shrewsberry v. Aztec Sales & Service Co., Inc., 445 S.E. 2d 253, 191 W.Va. 312, in which the Supreme Court upheld a jury verdict for Mr. Burgess' client in a case of wrongful replevin

Lilly v. City of Beckley, 797 F. 2d 191 (4th Cir. 1986), a leading case in the Fourth Federal Circuit regarding reverse discrimination

Marion Square Corporation v. Kroger Co., 873 F. 2d 72 (4th Cir. 1989), reversed a lower court ruling adverse to Mr. Burgess' client

Manning v. Inge, 288 S.E. 2d 178, 169. W.Va 430, Mr. Burgess' first appellate case, in which he successfully defended the actions of a magistrate which were adverse to the local sheriff's office.
